It’s almost twenty years since the National Minimum Wage (NMW) was introduced back in 1998, so, despite the introduction of an additional level last year (the National Living Wage), you would have thought that any teething problems with the rules would have been ironed out long ago – however even the largest employers still face claims for (what is often inadvertent) underpayment.

In the most recent round of “naming and shaming”, the Department for Business, Energy and Industrial Strategy (BEIS) revealed the names of 233 employers who had failed to pay more than 13,000 staff the National Minimum Wage (NMW) or National Living Wage (NLW) – with arrears just short of £2m and fines of £1.9m.

HMRC is currently investigating around 2,000 cases of underpaid wages. Also we have last month’s ruling by the Nottingham employment tribunal against the Best Connection Group, an employment agency that supplies large numbers of staff to Sports Direct. Given the large sums involved (they were fined £263K in multiple penalties and ordered to pay almost £470,000 to the underpaid workers), we thought this was a good time to take a look at some of the pitfalls that are tripping up unwary employers.
