Employment tribunal decisions now available online

Members of the public can now view employment tribunal decisions in England, Scotland and Wales on the Government’s website.

Before this new service was launched, people could only view employment tribunal decisions if they personally attended the offices in Bury St Edmunds for Welsh and English decisions, or Glasgow for Scottish decisions.

Members of the public can view a selection of decisions from 2015, 2016 and 2017.

Employers warned against using online database to screen candidates

Following the launch of the new service, employers have been urged to resist using it to screen potential candidates. There is concern that employers could themselves face tribunal cases and potential fines if they were to do so.

Employers may think they are protecting themselves by ‘screening’ candidates who have brought a claim against a previous employer. But it could actually leave recruiters vulnerable to claims of discrimination, victimisation or whistleblowing. If a candidate believes they’ve been blacklisted and subjected to discrimination, then they could have grounds to bring an employment tribunal claim.

Furthermore, employers also need to be aware that this new online database will mean customers, competitors, employees and potential candidates can discover cases of employment litigation involving them.
